HUD sent on August 2 a pre-rule, “Affirmatively Furthering Fair Housing [AFFH]: Streamlining and Enhancement,” for review by the Office of Information and Regulatory Affairs (OIRA) at the Office of Management and Budget. There is no further information about what this pre-rule entails.
The OIRA Frequently Asked Questions webpage explains that a pre-rule is also known as an Advance Notice of Proposed Rulemaking: “Pre-rule (or advance notice of proposed rulemaking) - Agencies undertake this type of action to solicit public comment on whether or not, or how best, to initiate a rulemaking. Such actions occur prior to the proposed rule stage.”
